Everlasting is a digital legacy platform that allows users to securely store, manage, and transmit messages, digital assets, and important information to designated beneficiaries. The Service includes features such as a digital vault, dead man’s switch, beneficiary management, and encrypted message delivery.

3. User Responsibilities

You are responsible for maintaining the confidentiality of your account credentials. You agree to provide accurate information and to keep your account details up to date. You must not use the Service for any unlawful purpose or to store illegal content.

4. Dead Man’s Switch Disclaimer

The Dead Man’s Switch feature operates on a best-effort basis and is not legally certified as a death verification mechanism. Everlasting relies on user-configured check-in intervals and third-party verification services. We do not guarantee the accuracy or timeliness of death verification or message delivery.

5. Cryptocurrency & Digital Assets

For cryptocurrency keys and sensitive digital assets, we strongly recommend using certified hardware wallets as the primary storage solution. Everlasting’s digital vault is designed as a supplementary secure storage option and should not be considered a replacement for industry-standard cryptocurrency security practices.

6. Limitation of Liability

Everlasting is provided “as is” without warranties of any kind. We shall not be liable for any indirect, incidental, or consequential damages arising from the use of the Service, including but not limited to delayed or failed message delivery, data loss, or unauthorized access despite our security measures.

7. Intellectual Property

All content, trademarks, and intellectual property on the Everlasting platform are owned by Everlasting or its licensors. Users retain ownership of their uploaded content but grant Everlasting a limited license to store, process, and transmit such content as necessary to provide the Service.

8. Subscription & Payments

Certain features require a paid subscription. Subscription fees are billed in advance on a monthly or annual basis. Refunds are handled in accordance with our refund policy. Free trial periods, where offered, will automatically convert to paid subscriptions unless cancelled before the trial end date.

9. Termination

We reserve the right to suspend or terminate your account for violation of these Terms. Upon termination, your data may be retained for a reasonable period to allow beneficiary access as configured, after which it will be securely deleted.

10. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these Terms shall be resolved through arbitration or in the courts of competent jurisdiction.
